Due to controversy surrounding the issue of whether VI should be included in consideration of legal insanity, the laws governing legal insanity differ greatly among states and have undergone substantial changes in many jurisdictions. The major reasons for differing views on whether VI should be taken into account when assessing insanity include difficulty in assessing and quantifying VI, difficulty in differentiating it from poorly planned or impulsive acts, and society’s hesitancy to excuse the types of offenses and psychiatric impairments that may lend themselves to a insanity defense due to VI alone. Whether to consider one’s ability to refrain from committing a crime or irresistible impulse, due to mental illness has been one of the primary exculpatory variables. Legal tests for insanity have changed over time and differ by jurisdiction. The topic of volitional impairment (VI) in insanity evaluations has long been a subject of some controversy. Insanity defense, not guilty by reason of insanity, irresistible impulse This paper examines the history of and rationale for a volitional test of insanity and how it is assessed by forensic evaluators. Some evaluators’ reports offered an opinion, but did not adequately explain what data they used to arrive at their conclusion. Many of the forensic evaluators concluded that the VI group was unable to refrain from illegal conduct based on considering a number of factors, including psychiatric symptoms and the defendant’s behavior as related to the offense. Criminal charges were also similar, but the VI group was more likely to have been charged with murder. ![]() Diagnostically, the VI and CI groups were similar. Of the 416 defendants assessed as NCR by the hospitals’ court-appointed evaluators, 44 (11%) were assessed as NCR due to VI alone. During a four-year period, 1,446 defendants underwent in-depth (post screening) evaluations for the NCR plea at Maryland state hospitals. Maryland’s test for a finding of legal insanity (not criminally responsible ) allows a defendant to be found legally insane due to either a lack of appreciation of wrongfulness (cognitive impairment ) or lack of ability to refrain from illegal behavior (volitional impairment ). ![]() ![]() I also want you to make a clear-eyed call on whether your home that you love today is the right place for an older you. At a not-high annual inflation rate of 3%, something that costs $2,000 today will cost more than $3,600 in 20 years. And those costs tend to rise over the years. But let's remember you still have property tax and insurance to pay each year, as well as taking care of the home and property. Sure, having the mortgage paid off is a big plus. I understand the emotional desire to stay in your current home, but I also know you will be miserable - and your adult children will be burdened - if you can't really afford to stay in this home. This is such a crucially important stand in your truth moment. That said, I want to be clear that you must first determine that you can afford to stay put. This research is just one more reason to consider paying off your mortgage before you retire, especially if you think you may stop work before you can enroll in Medicare at age 65. But here we are.Īt least the burden seems to lift a bit once people become eligible for Medicare at age 65.įor people at least 65 years old, there was no difference in prescription drug spending whether they had a mortgage or had paid it off. In a better world, we would not have a health care system that makes access such a financial burden that people are self-rationing their own care. That implies that people with a mortgage may be so cash-strapped that they find it harder to pay for prescription drugs. The Joint Center for Housing Studies at Harvard University found that both workers and retirees between the ages of 50 to 64 who had paid off a mortgage spent 50% more on prescription drugs than people who still had a mortgage. Removing that cost is a gift in retirement, as it means you need less monthly income to cover your bills.Īnd now comes a sobering research report pointing out another reason to pay off the mortgage if you intend to retire earlier than 65. I have long recommended that anyone who plans to stay in their current home when they retire should aim to have the mortgage paid off before they stop working.įor most households, a mortgage payment is the single largest monthly cost.
